These terms govern this website. They are not the agreement under which we do client work — that one is signed, and it controls.
These terms
These terms are an agreement between you and Purveyor Sports about your use of purveyorsports.com. By using the site you accept them. If you do not, please do not use the site.
What this site is, and what it is not
This is an informational website. It describes what we do and who we do it for.
Nothing on it is an offer, a quotation, a commitment, or a guarantee of a result, and nothing on it creates a client relationship between us. Descriptions of our capabilities are descriptions, not specifications of what any particular engagement would deliver.
Our work for a client is governed by a separate written agreement signed by both parties. Where anything on this site conflicts with that agreement, the signed agreement governs, and these terms have nothing to say about it.
Not professional advice
What we publish here is general information about our field. It is not technical, legal, financial, or business advice for your situation, and it should not be relied on as the basis for a decision without talking to someone — us or anyone else — about your actual circumstances.
Using the site
Read it, share it, quote it with attribution. What you may not do:
- Interfere with the site or the infrastructure it runs on, or try to gain access to any part of it that is not published.
- Probe, scan, or test the security of the site without our written permission.
- Harvest the contact details or photographs of the people named on it, whether by hand or by machine.
- Scrape it at a volume that degrades it for anyone else, or use automated means to republish it wholesale.
- Use it to send us anything unlawful, or anything designed to damage a system.
- Present yourself as us, or use our name or marks in a way that suggests we endorse you.
Intellectual property
The text, design, diagrams, interactive figures, code, and name on this site belong to Purveyor Sports or are used under licence. Sixth Man is our trademark.
Client and partner names and logos belong to the organizations they identify and appear here to identify them. Nothing about their appearance transfers any right in them to us or to you.
What you send us
When you send us a message through the contact form you confirm that you are entitled to send us what is in it, and that it is accurate as far as you know.
Please do not send confidential or commercially sensitive material through the form. Until we have a confidentiality agreement in place we cannot treat what arrives as confidential, and a web form is the wrong door for it in any case. Tell us it exists and we will open a better one.
We use what you send to respond to you and to keep a record of the conversation, as described in our Privacy Policy.
Links to other sites
This site links to sites we do not control. We are not responsible for their content, their availability, or what they do with your information, and a link is not an endorsement.
Availability and changes
We may change, move, or withdraw anything on this site at any time, and we do not promise it will be available without interruption. Content is accurate as far as we know on the day it is published, and we do not undertake to keep every page current.
Disclaimer
To the fullest extent permitted by law, this site is provided as is and as available, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the site will be uninterrupted, secure, or error-free.

Limitation of liability
To the fullest extent permitted by law, Purveyor Sports and its people will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of your use of this site — whether the claim is made in contract, in tort, or on any other basis, and whether or not we were told such damages were possible.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Indemnity
If your use of this site in breach of these terms causes a claim against us, you agree to cover the reasonable costs of defending it.
Governing law
These terms are governed by the laws of the State of Illinois, United States, without regard to its conflict of laws rules. Any dispute about them or about this site will be brought in the state and federal courts located in Cook County, Illinois, and both of us submit to the jurisdiction of those courts.
General
If any part of these terms is found unenforceable, the rest of it stands. If we do not enforce something straight away, that is not a waiver of it. These terms, together with the Privacy Policy, are the whole of the agreement between us about this website.
We may update these terms. The current version is always the one on this page, and the date at the top says when it last changed. Continuing to use the site after a change means you accept the updated terms.
